Settlement Deed for Rs.251=00
First Part. (1) Shri Krishnashanker shastri age 85 years Res.at 1) Himalaya Park b/h Ajanta Chambers Ashram road Ahmedabad.14 Who will be called as First Part person of Settler the meaning Thereof will include Shri Krishnashanker Shastriji along with his Legal hairs.
Second Part: (1) Shri Krishnashanker Shastri age 85 yrs. Res. at 17 Himalaya Park B/h Ajanta Chambers Ashram Road Ahmedabad.14 prof. Religious Preacher Religion Hindu.
(2) Shri Dineshbhai Purushotamdas Mehta age 65 yrs. Res. 14 Himalaya Park B/h Ajanta Chambers Ashram Road Ahmedabad.14 Prof. Social services Religion Hindu.
(3) Shri Thakorlal P. Mehta Age.85 yrs. Res. 14 Pratap gunj Baroda Prof. Retired Religion Hindu.

In this Deed all these will be called as second part of the TRUST DEED. The Meaning of the word they are second part and by this settlement deed they are time by time trust deed of the trust. The first part want to create a trust for public Charitable cause he wishes to create a trust of
Rs. 251=00 the Second party personal have also agreed to work as trustees of such Created trust. For such cause first party offer Rs. 251=00 by Way of this deed and the second party accept
Rs. 251=00 from the First party and the trust is created. The terms of the trust are as follows.
(1) As aforesaid the first party has handed over Rs.251=00 two Hundred fifty one only to second party and this amount will Be called, as "The trust assets" and the meaning of this will be those investment done from time to time and reinvested and Donations, gifts, and other amount received by trust are all Included in this meaning.
(2)The name of the trust will be :"SHRI PURUSHOTTAM SEVA TRUST".
(3)The Objects of the trust are as follows,
(a) The objects of the trust are public charitable and the trust Will work as per those Aims It is cleared that trust so created For the Public Charitable causes. This trust will work for citizen of India without any differences between caste, color or religion, and the Trust will not work for the particular caste or a division or Religion and the trust will not work for profit making and will not do any thing with intention of profit making.
Generally the all public charitable objects by legal way will be of this trust but without and effect of these public objects trust will work with appropriated and the common objects of Public interest. The trust will work for these special goals causes as follows.
(b) Service activities for the benefit of people of India.
(c ) For the objects of Education: giving scholarship, such loan may be given with or without interest may be given with or without Guarantor and will provide books, fees and teaching them regular or Vocational after calling in a classroom. The Trust will decide Whether fees for such training should be taken or not.
(d) To take necessary steps for spreading knowledge or technical, agriculture, medical or engineering so that they earn. To establish School for old age illiterate people or villages. Such activities to be done with or without charging fees.
(e) To serve such institute who are doing such activities as above and having no intention to make profit.
(f) Considering famine, time to time to make arrangements and distributing grass and prepare water tank for animals.
(g) To establish and run cold water huts for road moving public of highways.
(h) To supply water for water tank, water hut to agriculture crop. The trust may prepare a bore well.
(i) To establish and run rest house and serve food in "Annkshetra" to road going public of the highways.
(k) To establish Gaushala for Cows and Buffaloes and to serve Butter milk along with food in Annakhsetra made out of these cow's and buffaloes.
(l) To render medical aid, and medicine to village people. In Medical camp should be arrange in co-operation with donors and service institutions and to procure medicine and to distribute it hospital and needy patients.
(m) To held directly or indirectly to the people suffering from calamities like accidents high or low rainfall Earthquakes fire, riots, etc any where in India.
(4) The Trustees will enjoy following rights by this trust deed.
(a) Utilizing the trust estate and income as per Aims.
(b) To accept Donations Gifts in any kind which is appropriated to trust Aims. While accepting such cash donations or movable or immovable properties or securities or fixed assets which is appropriated to trust objects, and accepting such donations with name of donor or to accept any condition for donation the decision of trustees will be final.
( C) To donate from the trust properties and cash to other trust who are working in similar charitable causes in form of immovable properties or cash. The decision of the trustees will be final.
(d) To accumulate income and to amalgamate or merge the income or corpus and even income or any year and unused income of any year will be considered as amalgamated in corpus. But if the trustees have taken any decision for above then have to work accordingly.
(e)To purchase, acquire to get on hire or lease the land, house, movable or immovable properties and construct over such land, to change the existing shape or to make alterations or repairs or to purchase or to hire or rant acquire the necessary furniture- fixtures, vehicles books, for the objects of the Trust or rent or in exchange.
(f) To land, to give or rent, license fees, confessional fees or with or without and fee the own property of trust to other who are in the similar trust activities.
(g) To appoint governing Body, advisory board, committees, or to appoint paid or honorary staff to manage the trust and the institute established by the trust. The trustees have power to appoint or remove the staff members. Also Trustees have power to appoint accountant auditor for audit and to fix their remuneration.
(h) To advance loan to staff or contractors by cash or cheque with or without interest. The loan given to the staff will be equal to their monthly salaries and will be recovered in monthly installments.
(i) To construct buildings for the projects or the trust and Administration. Such constructions may be carried out as with material or only labor rates. The trustees have power to purchase such material under their direct supervision. The trustees have power to assign such contracts in lowest rate tender or by negotiations of rates.
(j) For operational facilities of the trust money the trustees have power to open and operate bank accounts, fixed deposits, securities, guarantees, sales and buying and have power to give the money by way of overdraft from the banks. Also the trustees have power to keep and operate bank lockers. In all this operations should be done be joint signature or where no.1 signature is compulsory and any one from the rest.
(k) The trustees have got legal right and power to take legal suits, to defend to dispose off for the trust. They have also power to accept arbitrator for the disputes and to accept decisions on the arbitrator and also to accept and act as per the compromise for any claim or to let off such claim.
(l) The trustees have power to do anything for the above aims.
(5)The trustees have power to utilize from time to time in the way they feel suitable all or part of its income or properties for the trust aims, and the decision taken by them is final. But the utilization of corpus or income by the trustees should be done within territories of India for trust aims only.
(6)The trustees have to maintain the accounts of the trust income and expenditure. The financial year of the trust shell be from 1st April to 31st march of every year.
(7)The Trustees can accept the assets or immovable properties if anybody want donate to the trust. The condition of such donor of the assets or properties shell be accepted by trustees if they are not in contradictory to the trust aims. But in any circumstances trustees have no right to change the name of the trust given by this trust deed. This means that donations received with the condition to change the name of the trust will not be accepted. And donation or property donated to the trust and accepted will become part of the trust assets.
(8)All securities and or investments and assets movable or immovable properties will be kept on trust name or on any two trustees names jointly.
(9)The trustees can open and operate the account like savings, current, fixed deposits in any schedule or co operative bank, of trust name or jointly all trustees names. All the money received shall be deposited or transferred in such accounts. But the trustees have right to keep some money from time to time for cash expenditure. Such account as resolved by majority of trustees can be operated as jointly by no.1 compulsory and any one of the rest.
(10)The trustees have got power to keep title deeds or the properties or securities in safe custody in bank of such deeds and securities in bank deposit vaults. The trustees can delegate to collect trust securities or income or donations to anyone or more banks, and also can give brokerage to such bank or banks for collection of safe custody of collections.
(11)The trustees would employ one secretary and joint secretary for their daily routine work and also clerks, watchman, cook, rabari or any other service persons required, and employ them with or without remuneration or with conditions, or they can relieved them or reappoint them and can pay wages, remuneration, honorarium, immolations, trustees may think suitable from the property or income of the trust, It is deem fit by majority or the trustees then may delegate such power to secretary joint secretary or board of other trustees who all are responsible to the main board of trustees.
(12)At present there are minimum 8 trustees and maximum can be eleven. But if trustees feel they can increase the maximum strength from more then eleven.
(13) From and amongst the appointed trustees as per deed Shri Krishnashanker D. Shastriji will act as President and Shri Dineshbhai P. Mehta will Act as Managing Trustee. They will be allowed to work like this so long they wish to work. But when they don't wish to work the rest of the trustees may appoint other in their place by majority.
(14)From the present trustees or from time to time if any of the trustee expires, or continuously out of India for more then one year or some trustee want to leave the trust or they don't wish to work or some trustee become incapable ,unfit or some trustee declared insolvent then in that case rest of the trustees may appoint new trustee on that post, Even without such incidence also trustees can appoint other trustee but at any time maximum number of trustees may not increase more then clause "12".
(15)Shri Krishnashanker Shastriji and Shri Dineshbhai P. Mehta both can nominate from his family who will work next to them. Thus the family member of their family become trustee. Such nominated family member trustee will also have permanent right to nominate from his family who will become next trustee after them. Incase these trustees have not made any nomination from his family the rest of the trustees will appoint some of there family member as new trustee.
(16)The receipt given of money by any of the trustees will be considered as the receipt given by the trust. But if the trust have to suffer any loss out of such act it will be the responsibility of that trustee.
(17) If some of the trustee has received money, security or property from trust then it is the responsibilities of the trust and no trustee will be made responsible for this and for the administration of trust if any money, security, or property is given to bank or other person and due to the fault of such bank or broker or other person loss arise then the trustees are not made responsible and any expenditure incurred by way of the trustee can get such money from the property or the trust.
(18)Managing trustee will work in absence of the president when he has gone out of state or nation, and the managing trustee will enjoy all powers that of the president and will sign all sort of documents, contracts, bank papers, correspondence or any other transactions which will be considered as done by the president.
(19)The trust creates under this deed is irrevocable document or this trust deed settlement deed contract, is made by us with our will and wish and being in sound mind and knowledge and in fully acceptable and binding to successors, nominees and assignees and legal hairs too.
